1. Overview
These Terms of Service (“Terms”) govern your use of Catapult Business Innovations LLC’s platform, services, software, and website (collectively, the Platform). Our primary website is https://www.icatapult.com.
These Terms form a legally binding agreement between you (“you,” “your,” or the “User”) and Catapult Business Innovations LLC (“Catapult,” “we,” “our,” or “us”).

- You will comply with all applicable laws, including HIPAA when relevant
2. HIPAA Compliance
Catapult provides HIPAA aligned AI agents and marketing tools for healthcare providers. If your use of the Platform involves PHI, the following applies.
- BAA required: a signed Business Associate Agreement (BAA) must be executed before transmitting PHI
- Permitted use only: PHI may be used and disclosed only as permitted by HIPAA, your BAA, and applicable state laws
- Your safeguards: you are responsible for privacy and security for your devices, systems, and staff training
- Our processing limits: Catapult processes PHI only in accordance with your instructions under an active BAA
3. Data Privacy and Security
Catapult employs administrative, technical, and physical safeguards designed to protect your data, including PHI when a BAA is active. Measures may include:
- Encrypted communications (SSL or TLS)
- Role based access controls
- Multi factor authentication (MFA)
- Secure U.S. based hosting
- Security monitoring and incident response procedures
4. Permitted Use and Restrictions
You agree to:
- Use the Platform only for lawful purposes
- Not transmit harmful, illegal, or harassing content
- Not reverse engineer, decompile, or modify the Platform
- Not share your login credentials or give access to unauthorized users
5. Communication Features (TCPA and HIPAA)
The Platform includes AI powered SMS, email, and voice features. When you use these features, you are the sender. You are responsible for complying with applicable laws, including:
- HIPAA for patient communication
- Telephone Consumer Protection Act (TCPA)
- CAN SPAM Act
- Do Not Call (DNC) registry rules
6. Third Party Services and Integrations
You may choose to integrate third party services with the Platform (for example EMR or EHR systems and analytics tools). Catapult is not responsible for the privacy, security, or performance of third party services.
7. Termination and Account Suspension
Catapult may suspend or terminate your access if:
- You breach these Terms or an executed BAA
- Your payment method fails or your account becomes delinquent
- You engage in prohibited or unlawful use, including violations of TCPA or HIPAA
8. Limitation of Liability
To the maximum extent permitted by law:
- Catapult is not liable for any indirect, incidental, or consequential damages
- Our total liability for all claims will not exceed the amount you paid us in the three (3) months prior to the claim
- We are not responsible for losses caused by third party services, breaches originating from your systems, or misuse of the Platform
9. Intellectual Property
All content, software, AI models, and services on the Platform are the exclusive property of Catapult or its licensors. You may not use our branding, logos, or documentation without our prior written consent.
10. Updates to These Terms
We may revise these Terms from time to time. If changes are material, we will provide at least 30 days notice by email or a prominent notice on our site. Continued use after changes take effect means you accept the updated Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes arising from these Terms shall be resolved through binding arbitration in Carbon County, Pennsylvania. You agree to waive any right to a jury trial and to participate in a class action lawsuit.
